The facts
This was a motor accident insurance dispute rather than a criminal prosecution.
The vehicle owner made a claim after damage to the vehicle, which the insurer repudiated on the ground that the person driving at the time did not hold a valid driving licence.
The owner’s case was that this person was merely a cleaner and that the vehicle had actually been driven by the owner’s son, who held a valid licence.
The consumer fora below did not properly weigh two pieces of documentary evidence: the case diary and the post-mortem report.
On appeal, the Supreme Court held that these documents, among others, clearly showed that the person actually driving the vehicle was the one without a valid licence, and that the fora below had erred in overlooking this.
