The facts
The accused, a police constable, was convicted of the rape of a young woman under Sections 346, 366 and 376 IPC, a conviction affirmed by the High Court.
On appeal, it emerged that the victim and other witnesses had failed to identify the accused in court.
The Supreme Court held that testing the accused’s identification, whether through a test identification parade or in court, is not a mandatory precondition to conviction, and that a defect in the investigation does not necessarily result in an acquittal.
The Court also emphasised that rape cases must be dealt with by courts with the utmost sensitivity, and that minor contradictions or insignificant discrepancies in the evidence should not be treated as fatal to the prosecution’s case.
Status: conviction upheld through final appeal.
