The facts
The respondents had been arraigned as accused under provisions of the Narcotic Drugs and Psychotropic Substances Act, 1985.
When the seized articles were tested at the Forensic Science Laboratory, the test showed that the items did not in fact contain any contraband.
On this basis, the Special Judge granted the respondents compensation under Section 250 of the Code of Criminal Procedure for having suffered illegal custody without reasonable cause, and the High Court upheld that order.
The State appealed to the Supreme Court.
