The facts
Six persons died a homicidal death, and the trial court convicted the accused under Section 302/34 of the Penal Code and imposed the death sentence, but the High Court acquitted the accused.
On the State’s appeal, the Supreme Court held that the evidence of two eyewitnesses, together with the doctor who conducted the post-mortem examinations and confirmed that all six victims died a homicidal death, was trustworthy and unimpeachable.
The eyewitnesses included the first informant, who lost his brother in the incident, and a minor child who lost five members of his family.
The Court found that this evidence did not suffer from any major contradictions, improvements, or noticeable embellishment, and noted that the FIR had been lodged promptly, treating this as additional assurance of reliability.
This combination of consistent eyewitness testimony and corroborating post-mortem evidence formed the basis for the Court’s review of the High Court’s order of acquittal.
Why this belongs in the Forensic Docket: A prompt FIR together with post-mortem findings that squarely match multiple eyewitnesses’ accounts can be strong enough to persuade an appellate court to revisit — and potentially reverse — a High Court acquittal even in a multiple-murder case.
