The facts
The accused assaulted a prosecution witness and killed the witness’s brother, and was convicted under Sections 148, 149, 304 Part II, 323, 324 and 325 of the Penal Code by the trial court, with the conviction affirmed by the High Court.
On appeal, the Supreme Court held that because the eyewitnesses, who were relatives of the victim, had a clear view of the assailants at the time of the incident, their evidence was reliable, and that any delay in holding the Test Identification Parade was immaterial once that direct eyewitness evidence was accepted.
The Court further held that the non-examination of a witness other than the eyewitnesses caused no prejudice to the accused.
The conviction was upheld and the appeal was dismissed.
Status: conviction upheld through final appeal.
Why this belongs in the Forensic Docket: Delay in conducting a Test Identification Parade will not doom a prosecution where eyewitnesses who knew the assailants had a clear, direct view of the incident — the strength of the ocular account can outweigh procedural delay in the TIP.
