The facts
This was a civil dispute over the validity of a will, in which the testator’s adopted son applied under Section 372 of the Indian Succession Act, 1925 for a succession certificate based on a will dated 15 November 1978.
The will’s validity was challenged, and the trial court rejected the application, holding the will invalid; both the Single Judge and the Division Bench of the High Court reversed that finding and directed issuance of the succession certificate.
On further appeal, the Supreme Court held that two witnesses had satisfactorily proved the execution and attestation of the will by two attesting witnesses, and that the testator’s signature had been endorsed as genuine by two handwriting experts, whose opinions were corroborated by a forensic report.
The widow’s challenge to the will accordingly failed.
