The facts
The case involved the abduction and murder of a victim with whom the accused persons had a prior enmity.
According to the prosecution, the accused abducted the victim, killed him, and dumped his body on railway tracks.
Because the body’s identity was not known at the time, the police buried it after investigation.
Later, upon a complaint about the victim’s disappearance, the police exhumed the body, and a DNA examination confirmed that the remains were those of the missing victim.
On the strength of this DNA-confirmed identification together with other circumstantial evidence, accused nos.
1 to 3 were convicted, and the Supreme Court, on appeal, upheld that conviction based on the chain of circumstantial evidence, including the DNA identification of the exhumed body.
