Bheru Lal & Ors. v. State of Rajasthan — Blood-stained article recovery corroborating conviction

The facts

The complainant’s two sons were murdered and her property set on fire, allegedly by the accused.

The trial court convicted the accused, and the High Court upheld that conviction.

Before the Supreme Court, the accused raised several defences: that the prosecution witnesses were interested parties, that the prosecution had failed to explain injuries found on one of the accused, and that the accused had acted in exercise of a right of private defence.

The Court rejected all three: it held the injuries on the accused were extremely insignificant and did not require any explanation from the prosecution, and that the defence witnesses were unbelievable.

On the affirmative side, the evidence of the complainant’s mother, together with the recovery of blood-stained articles and clothing, was held to fully establish the accused’s guilt.

The conviction was accordingly sustained.

Status: conviction upheld through final appeal.

Why this belongs in the Forensic Docket: Minor, unexplained injuries on an accused person are not automatically a fatal gap in the prosecution’s case — this judgment shows how physical recovery evidence like blood-stained clothing can carry a conviction even when the defence tries to flip the burden onto the prosecution.
