The facts

The headnote in this case sets out several evidentiary principles applied in upholding the conviction.

On the testimony of a relative of the deceased, the Court held that such evidence can be relied upon, though it must be assessed with caution given the relationship.

On the test identification parade (TIP), the Court reiterated that its object is to test whether witnesses’ memory, based on their first impression of the offender, holds up — and held that where a delay in holding the TIP is due to circumstances beyond anyone’s control, that delay is not fatal to the prosecution.

The Court also elucidated the requirements of Section 27 of the Evidence Act, which allows facts discovered as a result of information given by an accused in custody to be proved, and clarified the meaning of the phrase ‘fact discovered’ under that provision.

Why this belongs in the Forensic Docket: Delay in holding a test identification parade is not automatically disqualifying — investigators should focus on documenting why the delay occurred, since courts will excuse it when the cause was genuinely beyond their control, while a relative’s testimony and Section 27 recoveries can each do real evidentiary work if properly grounded.
