K.H. Shekarappa & Others v. State of Karnataka — Medical evidence in custodial death conviction

The facts

Five persons were beaten by police officials inside a police station; two of them died and the other three sustained injuries.

The Supreme Court held that the combination of ocular testimony and medical evidence proved the prosecution’s case against the accused police officials.

Critically, since the deceased had been brought into the police station alive but were produced dead before the medical officer, the Court held it was for the accused to explain the circumstances in which the victims died in custody.

The accused instead put forward a false defence, which the Court treated as reinforcing their guilt rather than raising a doubt.

On this basis, the conviction and sentence of the accused were upheld.

Status: conviction upheld through final appeal.

Why this belongs in the Forensic Docket: In custodial-death cases, the medical evidence of how and when death occurred does double duty — it proves cause of death and it shifts the burden onto those who had custody to explain it, which is exactly the kind of documentation investigators must get right at the time.
