The facts

The prosecution’s case was that the accused persons inflicted injuries on a vital part of the deceased’s body, resulting in his death, an offence charged under Section 302 read with Section 34 of the Penal Code.

The trial court convicted the accused on the basis of the evidence led, and the High Court upheld that conviction.

On further appeal, the Supreme Court affirmed the conviction, holding that the prosecution’s version was corroborated both by the evidence of another prosecution witness — which shed light on the accused’s conduct on the day of the incident — and by the recovery of the blood-stained weapon of offence at the instance of the accused.

The cumulative effect of the injuries found on the deceased’s body was also treated as supporting the prosecution’s case.
