The facts
The courts below had convicted the accused under Section 302 of the Penal Code on the strength of circumstantial evidence, which included the identification of a motorcycle said to have been recovered in connection with the offence, and an identification issue concerning the accused himself.
The Supreme Court held that, in a case built on circumstantial evidence, there was nothing on record to show that the accused had actually committed the offence.
It set aside the judgments of the courts below and acquitted the accused, the identification evidence relating to both the accused and the recovered motorcycle having failed to complete the chain of circumstances required for a conviction based purely on circumstantial proof.
