The facts
The appellants were convicted under Sections 325 and 323 read with Section 34 of the Penal Code for allegedly assaulting two witnesses, PW-5 and PW-6, with lethal weapons and causing them injuries.
The Supreme Court, examining the record, found that the prosecution had not approached the case with clean hands and that the genesis of the incident was unclear.
It also identified a contradiction between the medical evidence and PW-5’s own testimony regarding the number of injuries he had sustained.
Further, while PW-5 testified that his injuries were caused by a farsi, a luhangi, and sticks, the medical opinion indicated that the injuries were consistent with a hard, blunt object rather than the specific weapons described.
On the strength of these inconsistencies between the ocular and medical evidence, the appeal was allowed.
Why this belongs in the Forensic Docket: A textbook example of how a mismatch between the weapons an eyewitness describes and what the medical opinion actually supports can unravel a prosecution — investigators should resolve such ocular-versus-medical contradictions before trial rather than after conviction.
