The facts
The accused was convicted under Section 307 read with Section 34 of the Penal Code for allegedly attacking the complainant with a knife and trying to cut his throat.
The complainant deposed that he sustained injuries on his palm while trying to save himself from the attack.
The Supreme Court’s headnote records that the injury report, however, showed that the complainant did not in fact have an incised injury on the palm — only a bruise, which could have been caused by a blunt instrument rather than a knife.
Compounding this, the knife and the mat said to bear blood stains had not been sent for forensic examination at all.
Taken together with a delay in lodging the FIR, the Court held that the possibility of fabrication of the case could not be ruled out, and allowed the appeal in favour of the accused.
Why this belongs in the Forensic Docket: This case is a textbook failure to document: alleging a knife attack while the injury report shows only a blunt-force bruise, and then never sending the supposed weapon or blood-stained mat for forensic testing, left the prosecution with no way to close the gap between its story and the physical evidence — a lesson in why every forensic exhibit that could corroborate or contradict a claim must actually be tested.
