The facts

The accused had been convicted by the trial court, but the High Court set aside that conviction and acquitted them, relying on a number of circumstances that undermined the credibility of the prosecution’s version.

On the State’s appeal against this acquittal, the Supreme Court held that the High Court’s judgment could not be said to be perverse so as to warrant interference, and dismissed the appeal.

Among the circumstances the High Court had relied on, and which the Supreme Court referenced, was the non-seizure of a blood-stained axe belonging to PW-1 from the spot of the occurrence — treated as a highly suspicious gap in the investigation that went to the credibility of the prosecution’s case as a whole.
