The facts
The case concerned the evidentiary value of a dying declaration under Section 32 of the Evidence Act.
Medical evidence showed that the injured person’s brain functions had been impaired by a brain injury, bearing on whether he could still have spoken and made the declaration relied upon.
Separately, the case examined serological evidence on weapons recovered: blood on one axe was found to be of human origin, while blood on another axe could not be conclusively typed by the serologist because the serum had disintegrated.
The Supreme Court held that this inconclusive result did not mean the blood on the second axe was not human blood, and that the recovery of that weapon would not be reduced to disutility as evidence merely because the serological test could not confirm its origin.
On the State’s appeal, the conviction was upheld.

Why this belongs in the Forensic Docket: An important precedent for serology: an inconclusive blood-typing result caused by degradation of the sample does not neutralise the evidentiary value of a recovered weapon — examiners should document why a test is inconclusive (e.g., serum disintegration) so courts can distinguish ‘not proven human’ from ‘proven not human’.
