The facts
The accused was prosecuted under Section 376 of the Penal Code for rape, with the version of the prosecutrix said to be corroborated by three witnesses.
The trial court convicted him, but the High Court acquitted him, disbelieving the corroborating evidence and citing the non-availability of a Chemical Examiner’s Report.
On the State’s appeal, the Supreme Court held the accused liable, restoring the conviction.
It reasoned that corroboration of the prosecutrix’s version by an independent witness in every material particular is not an absolute requirement in rape cases: where her testimony is free from blemish and implicitly reliable, a conviction can be recorded even without a Chemical Examiner’s Report or other corroborating evidence, provided her account otherwise inspires confidence.
