The facts
The accused, riding a motorcycle, were found in possession of a large quantity of opium, leading to a prosecution under Sections 8, 18 and 55 of the NDPS Act, 1985.
At trial, the accused argued that the samples collected at the time of recovery had not reached the Forensic Science Laboratory with their seals intact, but the trial court rejected this plea and convicted them.
The High Court, however, acquitted the accused.
On the State’s appeal, the Supreme Court noted that the question of whether a broken seal on samples sent to the FSL vitiates a conviction has been considered in a large number of its own prior decisions, and found that the High Court’s order was bereft of any discussion or reasoning on the point.
The Supreme Court therefore set aside the High Court’s acquittal and directed the High Court to reconsider the matter afresh in accordance with law.
Why this belongs in the Forensic Docket: Seal integrity between seizure and the FSL is treated by the Supreme Court as a well-settled but fact-sensitive question — an appellate court cannot dispose of it without reasoned discussion, and every seizure officer should assume that exact question will be tested.
