The facts
The accused was convicted by the trial court of murder by poisoning under Sections 302/34 and 328/34 of the Penal Code, but the High Court acquitted them.
On the State’s appeal, the Supreme Court upheld the acquittal, agreeing with the High Court that although the substance involved was found to contain poison, there was no evidence establishing where that poison had come from.
Crucially, the Court noted that there had been no forensic examination of the food item that was shared between the witness and the deceased, leaving a critical gap in the chain of proof.
The Court also found the alleged motive for the crime to be improbable.
Because of this combination of an unexplained source of poison, the absence of forensic testing of the shared food, and an implausible motive, the judgment of acquittal passed by the High Court was upheld and the State’s appeal was dismissed.
Why this belongs in the Forensic Docket: In poisoning cases, failing to forensically test the shared food or drink at the centre of the allegation can be fatal to the prosecution — without that chemical link, even a body found to contain poison cannot establish who administered it or how.
