The facts
The accused was alleged to have fired at and killed the deceased.
The trial court convicted him on the basis of the ballistic report, the postmortem report, and the evidence of eyewitnesses.
The High Court, however, acquitted the accused.
On the State’s appeal, the Supreme Court held that the High Court had fallen into grave error of law and fact, resulting in a miscarriage of justice, and set aside the acquittal.
The judgment also addressed the evidentiary status of a report purporting to be issued under the hand of a government scientific expert, holding that a court may accept such a document from the officers specified under the relevant statutory provision without requiring the author of the document to be examined in person.
Status: conviction upheld through final appeal.
