The facts

The case turned on the evidentiary value of a Test Identification Parade.

The headnote records that, before the parade was actually conducted, the witness had been taken to the jail and shown the accused persons.

The Supreme Court held that once a witness has already been shown the accused in this way, there is no purpose left in holding a Test Identification Parade at all, since it can no longer test the witness’s independent power of recognition.

On that basis, the Court held the High Court was right to reject the prosecution’s case, and dismissed the State’s appeal against the acquittal.

Why this belongs in the Forensic Docket: Showing a witness the accused before a Test Identification Parade does not just weaken the parade — it destroys its entire purpose, and the Supreme Court treats that kind of contamination as fatal to the identification evidence built on it.
