Srivalla Srinivasa Rao & Ors. v. State of A.P. — FSL report and physical trace evidence, gang rape

The facts

Three accused were convicted of gang rape under Section 376(2)(g) of the Penal Code.

On appeal, they argued that the prosecutrix’s account was uncorroborated and that there had been delay in lodging the FIR.

The Supreme Court held that the prosecutrix’s evidence was supported by two other witnesses who had reached the scene, by medical evidence indicating the duration of the injuries, by the Forensic Science Laboratory report, by broken pieces of glass bangles recovered from the scene, and by the victim’s torn clothes — all of which corroborated the occurrence of the rape.

The Court further held that some delay in registering the FIR was not, by itself, fatal to the prosecution’s case, and upheld the conviction.

Status: conviction upheld through final appeal.
