The facts
This case arose out of a TADA prosecution following a landmine blast attack on a police convoy and a subsequent firearms attack, which together killed 22 people and injured several others.
The accused were convicted and sentenced to life imprisonment by the Designated Court.
On appeal, their principal plea before the Supreme Court was that no test identification parade (TIP) had been conducted to identify them.
The Court held, on the facts and evidence before it, that a TIP was not required in this case, and that the Designated Court had rightly convicted the accused.
Beyond affirming the conviction, the Supreme Court went further: on notice to the accused regarding sentence, it enhanced the punishment from life imprisonment to death, given the scale and nature of the attack.
The judgment establishes that the absence of a TIP is not fatal to a conviction where other evidence sufficiently establishes identity and involvement.
Status: conviction upheld through final appeal.
Why this belongs in the Forensic Docket: This case is a caution against treating TIP as a mandatory checkbox: examiners should document why a parade was or was not necessary, since courts will look past its absence when the surrounding evidence independently establishes identity.
