Shyam Babu v. State of U.P. — FSL report corroborating eyewitness and medical evidence

The facts

Five people were killed and one injured in a firing incident allegedly involving seven accused.

The trial court acquitted the accused, but the High Court convicted three of them; the appeal against the remaining four abated because of their deaths during its pendency.

Before the Supreme Court, the three surviving convicted accused challenged their conviction.

The Court held that the combined weight of the testimony of three eyewitnesses (one of whom was himself injured in the incident), the medical evidence, and the FSL (Forensic Science Laboratory) report together established the prosecution’s case.

It rejected the argument that any one accused should be exonerated merely because the case against the others had abated, holding that the sole surviving accused’s individual liability had still been independently established.

The conviction was accordingly upheld.

Status: conviction upheld through final appeal.

Why this belongs in the Forensic Docket: The abatement of an appeal against co-accused who die during its pendency does not weaken the case against the survivors — provided, as here, that eyewitness, medical and FSL evidence independently establish each individual’s role.
