The facts
A Constitution Bench ruling that administering narco-analysis, polygraph or Brain Electrical Activation Profile (BEAP) tests on a suspect or witness without consent violates Article 20(3), the right against self-incrimination.
Results from a voluntarily taken test cannot be used as evidence of guilt by themselves, though material subsequently and independently discovered with their help may be admissible under Section 27 of the Evidence Act.
The Court also flagged leaking narco-analysis recordings to the media as a serious risk of public stigma and media trial.
