The facts
This was a triple murder case under Section 302 read with Section 149, and Sections 147 and 148, of the Penal Code.
Two eyewitnesses had been accompanying the deceased at the time of the incident; one of them was killed during the trial and the other turned hostile.
Two further eyewitnesses supported the prosecution’s case, and their testimony was corroborated by medical evidence.
The courts below convicted the remaining accused, and the matter reached the Supreme Court on appeals against both the conviction and an acquittal.
The Court held that there was no reason to interfere with the orders of the courts below, since the prosecution’s case was proved by the testimony of the eyewitnesses as supported by the medical evidence.
Status: conviction upheld through final appeal.
Why this belongs in the Forensic Docket: Even when key eyewitnesses are lost to death or hostility during trial, medical corroboration of the surviving testimony can be enough to hold a conviction together — worth studying as a model for cases with witness attrition.
