The facts
This case concerned the scope of the High Court’s power under Section 482 of the Code of Criminal Procedure to quash criminal proceedings.
Following the death of a married woman, her father lodged a complaint against her husband and in-laws; the Magistrate summoned them and committed the case to the Sessions Court, but the Sessions Judge discharged the accused-appellants.
When the High Court reversed that discharge, the appellants approached the Supreme Court.
The Court held that the High Court’s approach was not justified on the facts, because the post-mortem report, the report of the Central Forensic Science Laboratory, and the inquest report were together sufficient to exculpate the appellants from the allegations made in the complaint.
It further observed that the mere fact that the deceased’s body had turned blue was not, by itself, evidence of foul play.
On this basis, the Supreme Court allowed the appeal and quashed the proceedings against the accused.
Why this belongs in the Forensic Docket: At the threshold stage, courts should weigh the forensic record already on file — a post-mortem and CFSL report that positively exculpate the accused can end a prosecution before trial, rather than leaving people to face a case the science itself does not support.
