The facts
Five accused allegedly attacked the victim with deadly weapons under Section 307 read with Sections 149 and 148 of the Penal Code, inflicting twelve grave injuries; this account was corroborated by medical evidence.
An injured eyewitness stated, both in his complaint and in his evidence, the specific role played by each of the accused.
The trial court convicted the accused, but the High Court acquitted them.
On further appeal, the Supreme Court held that the direct evidence of the injured eyewitness was not doubtful, and that the High Court, without discrediting that witness, could not have acquitted the accused; the High Court’s view was accordingly held unsustainable and the conviction restored.
Status: conviction upheld through final appeal.
