Part of the Forensic Docket on Legal Desire Forensics — how a forensic technique fared under appellate scrutiny.
The facts
Two DNA reports excluded the husband as the biological father of the child.
The Court held that where DNA evidence is conclusive, it can displace the statutory presumption of legitimacy under Section 112 of the Evidence Act, rather than the presumption automatically overriding the scientific finding.
Why this belongs in the Forensic Docket: Establishes how far a hard scientific result can go in overriding a long-standing legal presumption, a question that recurs whenever DNA evidence meets old evidentiary rules.
