Nand Kishore v. State of Madhya Pradesh — Medical & ocular evidence corroborating conviction

The facts

The case arose from a quarrel between a victim and a co-accused over recovery of dues.

During the altercation the co-accused caught hold of the victim while the main accused stabbed him; the appellant, a third accused, pelted stones at the victim, contributing to his death.

The trial court convicted the accused, including the appellant, of murder under Section 302 read with Section 34 of the Penal Code and sentenced them to life imprisonment; the conviction was affirmed by the High Court.

Before the Supreme Court, the appeal of the main accused and the co-accused was dismissed outright.

As to the appellant’s separate challenge, the Court held that there was definite documentary, ocular and medical evidence, together with the defence’s own admissions, establishing his role in causing the victim’s death, and accordingly upheld his conviction and sentence as well.

Status: conviction upheld through final appeal.
