The facts

The accused were convicted for gang rape and criminal intimidation under Sections 376(2)(g) and 506 IPC.

The Supreme Court held the conviction justified: the evidence of the prosecutrix was found reliable, the delay in lodging the FIR was adequately explained, and her account was supported by substantial evidence as well as medical evidence corroborating the prosecution’s case.

Separately, the Court reiterated the established principle that a Test Identification Parade does not constitute substantive evidence — a failure to hold one, or any deficiency in it, does not by itself undermine an otherwise reliable conviction.

The conviction recorded by the courts below was accordingly confirmed.

Status: conviction upheld through final appeal.
