The facts
Fifteen persons were accused of causing the death of one person under Sections 302 and 364 read with Section 34 of the Penal Code, in a case marked by pre-existing animosity between the parties.
Four eyewitnesses testified.
The trial court convicted three of the accused and acquitted the rest; one convicted accused’s appeal abated on his death.
The High Court upheld the conviction of two accused.
On further appeal, the Supreme Court held that the eyewitness accounts were fully corroborated by the statement of the Investigating Officer, the inquest report, the post-mortem report, and the recoveries made, and that a clear motive for the killing had also been established.
The prosecution was held to have proved its case beyond reasonable doubt, and the conviction was upheld.
