The facts
The appellant and two other accused were alleged to have deliberately dashed a motor vehicle into the deceased, who was thrown off his cycle, then tied behind the vehicle and dragged for a considerable distance; there had reportedly been prior threats to the deceased in the days before the incident.
The trial court convicted the appellant under Section 304 Part I, but the High Court altered this to a conviction under Section 302.
On appeal, the Supreme Court noted that the post-mortem report showed injuries on vital parts of the deceased’s body, that his face was crushed, and that there were further marks consistent with the alleged dragging, supporting the prosecution’s version of a deliberate and brutal killing rather than a lesser offence.
Status: conviction upheld through final appeal.
