
Herbert Smith Freehills Kramer (HSF Kramer) secured a significant result on behalf of FreshRealm’s first-lien lender and DIP agent, Birch Grove.
After a contested confirmation hearing where HSF Kramer advocated on behalf of Birch Grove, the US Bankruptcy Court for the District of New Jersey approved FreshRealm’s Chapter 11 liquidating plan. The decision overruled objections involving third-party releases and rights to certain insurance proceeds.
All classes eligible to vote had supported the plan.
