The facts

The accused’s conviction was challenged before the Supreme Court primarily on the ground concerning the evidentiary value of the Test Identification Parade (TIP) conducted during investigation.

Restating settled principles under the Evidence Act, 1872, the Court explained that a TIP is meant to test a witness’s memory based on their first impression of the accused and to help the investigating agency decide whom to actually put up for trial; the exercise is meaningful only where the accused was not already known to the witness.

A TIP is not, by itself, substantive evidence of identity — its value lies in corroborating identification made later in court.

While it is desirable to hold a TIP as soon as possible after arrest, the Court reiterated that the mere failure to hold one is not automatically fatal to the prosecution’s case where other reliable evidence supports identification.

Applying these principles, the appeal was dismissed and the conviction affirmed.
