Gajoo v. State of Uttarakhand — Weapon and blood-stained clothing recovery corroborating murder conviction

The facts

The appellant and one other accused were convicted under Section 302 of the Penal Code for the murder of a widow.

The Supreme Court upheld the conviction, holding the challenge to it untenable.

The evidence showed that the injuries on the victim were inflicted by the appellant using a ‘Daranti’ (a sickle-like implement) in one hand while holding the victim’s neck with the other, and that both accused, being of considerably greater physical strength than the victim, together forced her to the ground in a manner that caused her death.

The recovery of the Daranti and a blood-stained pyjama was duly established and corroborated the prosecution’s version, and the Court found this recovery evidence, taken together with the rest of the prosecution case, sufficient to sustain the conviction.

Status: conviction upheld through final appeal.
