The facts
The accused was convicted by the trial court, and sentenced to death, for the rape and murder of a minor child, under Sections 302, 376(2)(f), 377, 363, 364, 367 and 201 of the Penal Code read with the Protection of Children from Sexual Offences Act, 2012.
The High Court confirmed both the conviction and the death sentence.
Before the Supreme Court, the Court held that the forensic reports on record, taken together with the accused’s extra-judicial confession, justified upholding the conviction.
However, the Court found that there was no material to show that the accused had intended to kill the victim, and no evidence of any premeditation on his part.
On this basis, while the conviction itself was affirmed, the Court did not sustain the death sentence that had been imposed on him.
Why this belongs in the Forensic Docket: Forensic evidence and a confession can nail down guilt, but they don’t automatically prove intent to kill — for the harshest sentence, courts still look for separate proof of premeditation before extending a conviction into a death sentence.
