The facts
The accused was convicted under Section 302 of the Penal Code for murder on the strength of circumstantial evidence, and the Supreme Court found that the chain of events pointed clearly to his guilt.
In addressing the evidentiary issues raised, the Court also dealt with the reliability of interested witnesses, holding that their creditworthiness ought to be the guiding factor in assessing their testimony, rather than treating their evidence as suspect merely because of their relationship to the case.
On the forensic side, the appellant argued that the evidence of a handwriting expert should not be relied upon in the absence of corroboration.
The Supreme Court rejected this argument, holding that there is no rule of law, nor even a rule of prudence, that requires an expert’s opinion to be corroborated before it can be acted upon.
Finding the circumstantial evidence and the expert testimony together sufficient, the Court dismissed the appeal and upheld the conviction.
Status: conviction upheld through final appeal.
Why this belongs in the Forensic Docket: Handwriting-expert opinion does not need a corroborating witness to be usable — but that only works when the underlying comparison itself is sound, so examiners should still document their method well enough to stand alone in court.
