What Arizona Residents Should Know About Personal Injury Claims

Arizona residents

Carlos drove home from work on a Thursday. Someone ran a red light in Mesa, hit the driver’s side. Herniated disc. Six weeks off work. Hospital paperwork in hand before he even got through the door.

Insurance company called Friday morning. Friendly, had a number ready. Nine thousand five hundred dollars.

He signed it Saturday. Needed the money. Wanted it over.

November he found out he needed surgery. Thirty-eight thousand dollars. The release he signed on Saturday covered everything permanently. No recourse. Nothing left to do.

He didn’t know he had options. That’s not stupidity. Nobody told him.

The Basic Setup

Arizona is a fault state. You file against the other driver’s liability insurance. Their company has a direct financial interest in paying you less than your case is worth and their adjuster has done this hundreds of times this year alone.

You’re doing it once. That gap is real and it shows up in the first offer.

Comparative Fault

Pure comparative fault. Your percentage of responsibility comes directly off your recovery. Thirty percent at fault on an eighty thousand dollar case means fifty-six thousand. Seventy percent at fault you still recover something.

That’s more plaintiff-friendly than most states. It also means adjusters push shared fault arguments hard because small shifts move real money. They look for anything that sticks. Your speed. Whether you were paying attention. Whether you could have done something differently. They raise these arguments on thin evidence specifically to see how you respond

Tell your attorney everything. The uncomfortable parts especially. What you hold back surfaces later at the worst possible time.

The Deadline Nobody Warns You Abou

Two years from the injury date to file. Real investigations take months. Medical records take time. Expert consultations take time. Negotiations can drag for over a year. Two years disappears faster than people expect.

Here’s the part that actually trips people up: claims against government entities in Arizona can have notice requirements as short as 180 days. Crash involved a city vehicle? A county road that wasn’t maintained? A traffic signal with complaints already on file? That shorter clock started the day it happened. Most people find out about it after the window closes.

Same Day

Go to the doctor the day of the crash. Not Friday morning. Thursday night.

Carlos waited two days. That gap was the first thing the adjuster used.

Adrenaline masks damage in ways that aren’t obvious until later. Soft tissue injuries, spinal problems, concussions, they don’t always show their full picture for 24 to 72 hours. Feeling mostly okay after impact tells you very little about what’s actually going on.

Tell the doctor you were in an accident. Those words need to appear in the record. Show up to every follow-up. Every referral. A gap in the treatment timeline doesn’t read as a busy schedule. It reads as recovery, and recovery means the adjuster owes you less.

Write things down while they’re happening. What you can’t do anymore. How you’re sleeping. What you’ve had to cancel or skip. Six months from now someone will ask for specific details about your experience and you won’t remember them without notes.

The Call

Day one or day two. Calm voice, number already prepared.

They call fast because they want a settlement before treatment is finished and before you know what everything actually costs. Before you find out whether surgery is coming. Before you understand if what you’re managing right now is a six-week problem or a permanent one.

Carlos signed Saturday morning when he was tired and just wanted it over. November he found out what that decision cost him.

Don’t give the other driver’s insurer a recorded statement without talking to an attorney first. Don’t sign anything. Both of those decisions made in the first 48 hours matter more than most of what happens throughout the rest of the entire process.

Your Own Policy

Arizona minimums are $25,000 per person for bodily injury. Carlos’s surgery was $38,000. The driver who hit him carried minimum coverage.

When the other driver’s coverage isn’t enough, your own underinsured motorist coverage is the path forward. Go read your own policy tonight. Before any of this is relevant. Uninsured drivers are a genuine problem in Arizona and your uninsured motorist coverage is what protects you if one of them hits you. Know what you carry.

What You Can Actually Claim

Medical bills. Future treatment costs. Lost wages. Reduced earning capacity if the injury changes what you’re professionally able to do going forward. Every out-of-pocket cost the injury created.

Then pain and suffering, emotional distress, losing the ability to do things you did before, the impact on your marriage and family relationships. Arizona doesn’t cap non-economic damages in most personal injury cases. On a serious injury that number can be larger than the medical bills.

Justia’s personal injury resources explain what’s compensable in plain language without a sales pitch. Worth reading before you talk to anyone.

At the Scene

Both vehicles photographed from every angle before anything moves. The road, the intersection, skid marks, debris, your visible injuries, the weather, the lighting. Witness names and direct phone numbers before people leave because they leave fast and once they’re gone they’re gone.

Get the other driver’s full information yourself. Name, address, phone, license number, plate, insurance company, policy number. Don’t just photograph the card.

The Car

Separate claim from the injury even though both come from the same crash.

Insurance company total loss valuations run below actual market value consistently. Pull current Arizona listings for your exact year, make, model, and mileage. Use them to push back. Their first number is a starting position

Read every document before signing anything. Some property damage settlements include language releasing future injury claims. Carlos didn’t catch that on Saturday morning. That language is why the surgery cost him everything

Every word. Before the pen touches paper.

Before deciding on anyone for representation, go read what actual clients say about working with them. On Yelp, there are direct accounts from people who went through Arizona injury claims with the firm. More honest than anything published on a law firm’s own website.

Grand Canyon Law Group Arizona handles personal injury cases across the state. They know how Arizona courts actually function and how local insurers actually negotiate, which is different from how the statutes read on paper.

Carlos would have gone to urgent care Thursday night. Declined the recorded statement. Read the release before signing it

He knows exactly what that Saturday morning decision cost him.

Don’t find out the same way.
