A Latham IP Litigation team served as lead US International Trade Commission (ITC) counsel to Netlist in a Section 337 investigation against Micron Technology, Hewlett Packard Enterprise, Lenovo, and Super Micro Computer. Working alongside co-counsel Irell & Manella LLP and Sterne, Kessler, Goldstein & Fox PLLC, Latham filed the ITC complaint in August 2026, and the ITC instituted the investigation in late September. Shortly thereafter, on October 6, 2026, Netlist announced patent license and settlement agreements with Micron, resolving the dispute between Netlist and Micron at the ITC and all other pending litigation between the companies, bringing several years of litigation to a close. Under the agreements, Micron will receive a five-year term license to Netlist’s patent portfolio and pay Netlist US$600 million over the term.
The Latham team was led by partners Kevin Wheeler, Charles Sanders, Mike David, David Shaw, and Blake Davis, with counsel Chris Suarez and associates Kimberly Li, Shridhar Jayanthi, John Svendsen, Dana Han, Alyssa Dolan, and William Yao.
