DLA Piper has advised Greenvolt Power on the negotiation of two long-term tolling agreements with Statkraft in relation to the Ełk and Turośń Kościelna battery energy storage system (BESS) projects in Poland.
With a combined capacity of 400 MW and 1.6 GWh, the projects rank among the largest BESS developments in Poland and across the European Union. The agreements will enable the optimisation of the batteries across power and flexibility markets, while providing a predictable, long-term revenue stream for the projects.
A cross-border and multidisciplinary team from DLA Piper’s Warsaw and Vienna offices worked on the transaction led by partner Oskar Waluśkiewicz (Lit&Reg). He was supported by counsels Monika Leszko and Kenneth Wallace-Müller.
This matter provided another opportunity to draw on our experience across the energy sector, energy market regulation and complex contractual arrangements supporting the deployment and operation of energy storage assets.
Oskar Waluśkiewicz said: “The continued growth of utility-scale battery storage requires not only cutting-edge technology, but also innovative commercial structures capable of unlocking the value of asset flexibility. Advising Greenvolt on this landmark transaction marks another important milestone for the development of the Polish BESS market. We would like to thank Greenvolt Power for its trust and congratulate all teams involved on the successful completion of this significant transaction.”
