A consumer complaint had been filed before the State Commission of Mumbai alleging deficiency of services and unfair trade practices. This Complaint was allowed by the State Commission.
The State Commission’s order was challenged by THDCL before the NCDRC in first appeal. Pursuant to final arguments in the appeal, the NCDRC dismissed the allegations of deficiency in services and unfair trade practice and specifically observed that no deficiency of service can be fastened upon THDCL.
Additionally, the complainant’s review application and special leave petition challenging NCDRC’s order were also dismissed and NCDRC’s order was upheld. On May 4, 2023, the Judgment attained finality, as, in a limited review application filed by THDCL, the NCDRC while reiterating that no liability for deficiency of service can be fastened upon THDCL, additionally reduced the quantum of compensation payable to the complainant.
