Dentons advises the Netherlands Enterprise Agency on legislative reforms for wind energy development in Ukraine

In consortium with the Ukrainian Wind Energy Association (the UWEA) and other Ukrainian law firms, Dentons advised the Netherlands Enterprise Agency under the Ministry of Economic Affairs and Climate Policy of the Netherlands (RVO) on a series of comprehensive legislative reform proposals which aim to foster the development of wind energy in Ukraine.

On October 10, 2024, the UWEA, Dentons, and other consortium members presented the report “Legislation Fostering Wind Energy Development in Ukraine” at an event at the Embassy of the Kingdom of the Netherlands in Ukraine. The report identifies gaps in existing RES legislation and proposes legislative reforms to ensure the effective development of the wind energy industry in Ukraine.

The proposed legislative changes cover environmental, construction, and land aspects, as well as issues related to grid connection.

Dentons Energy partner Maksym Sysoiev presented the proposals regarding:

• Improvements in the operation of energy storage systems co-located with generation facilities.
• The possibility of allowing installed capacity of RES, storage and consumption facility connected to one point to exceed ordered/connected capacity.
• The introduction of “cable pooling” principles in Ukrainian legislation, such as the possibility of co-locating wind and/or solar capacities and energy storage facilities in new or existing RES power plants.
