What To Look For When Hiring Attorneys?

Most people do not need the services of an attorney unless there is a serious issue. This means that the average person does not have a lot of experience hiring an attorney, so when they have to hire one, it is natural for them to feel a bit overwhelmed or frustrated. Understanding what to look for when hiring an attorney can make the process easier and significantly increase your chances of securing a favorable outcome for your case. If you are considering hiring an attorney, here are five things to keep in mind.

Specialization 

Attorneys specialize in various legal disciplines. If you have been injured in an accident, you would go to a personal injury lawyer, if you have a child custody dispute, you would need a family law lawyer, or if you are facing criminal charges, you would need a criminal defense attorney. An attorney can specialize in multiple fields, but generally, their focus is limited to a few legal disciplines. This allows them to become experts in those types of cases. 

 

As legal matters are often complex, you need a lawyer who has a deep understanding of the laws, precedents, and regulations that apply to your case. Their specialization can also translate to a more extensive network of resources that can be extremely useful to your case. For example, a personal injury lawyer can tap into their network of healthcare professionals to get expert testimony to support your case.  

Experience 

While having the specialization is important, it is equally important for them to have experience. How many years of experience do they have? Do they have a track record of success in cases similar to yours? Are they in good standing with the bar? These are just some of the questions you should consider when trying to assess the experience of the attorney. 

 

An attorney who has many years of experience under the belt knows what challenges to expect from a particular type of case, and the common pitfalls to avoid. Additionally, their experience allows them to anticipate what their legal opposition might do, and develop strategies to counter those moves. Additionally, an experienced attorney is familiar with the local court systems and legal professionals, and they can use this to make informed decisions on legal strategies. If possible, try to find someone who was placed at their current firm by a Miami legal recruiter, as this means they are sought after for their skills.

Accessibility 

The specialization and experience of an attorney are not as useful if you can’t access them when needed. An attorney who is good at their job, but is overloaded with clients, might not have the time or the energy that your case deserves. While it is natural for the attorney to have a busy schedule, they should be accessible when needed. Timely advice from an attorney could be crucial for your case. In addition, you need to have peace of mind and trust knowing that you have the support of your attorney when needed the most.

 

 A lawyer who is accessible and provides regular updates on the case and can promptly reply to the client’s queries is an important quality to look for when hiring a new attorney.  You should not hesitate to ask the attorney about their availability and their place of communicating with you. 

 

In some cases, an attorney would delegate some tasks to paralegals and assistants, so you can also ask them to share how your case will be handled. While delegating tasks to a junior staff member helps them optimize their time and resources, you want the attorney to handle all the important aspects of the case, such as negotiation with the opposition, building a legal strategy, and courtroom appearance. 

Compatibility 

The attorney-client relationship needs to have compatibility as that can impact the success of the case. When hiring an attorney, you should consider their listening skills and communication style to assess if that matches your expectations and preferences. 

 

While some clients want their attorneys to be straightforward, to the point, and blunt in their legal counsel and advice, others want an attorney who is more reassuring and diplomatic. 

 

It can be difficult to assess compatibility in the initial consultation with the attorney, so you need to take some time to consider whether you feel comfortable with the attorney and would like to hire them. The more you engage with the lawyer early, the better you can assess your compatibility with them.  

 

The advocacy style of the attorney is also important. Some attorneys like to take an aggressive approach, where they are unapologetic and assertive in their legal stance. Others might have a more diplomatic approach where they like to negotiate with the opposing party to find a common ground. Some lawyers can also change their advocacy style based on the client’s needs. So, you need to be careful in not labeling or dismissing an attorney as a certain type only. 

References 

One of the most important aspects to consider when hiring an attorney is their track record, and you check this through references. This step usually comes when you have narrowed down your search to a couple of lawyers. 

 

Asking for lawyer references is important as it allows you to verify your assessments of the communication and responsiveness of the lawyer. Additionally, you get an idea of the success rate, so you know what to expect. Keep in mind here that every case is unique, so just because the lawyer has been successful in other cases, doesn’t automatically mean you will win your case. There are several factors that influence the outcome of any case, including the available evidence. 

 

References may also reveal any ethical issues that might not have been apparent during your interaction with the lawyer. For example, there could be issues with honesty or transparency regarding legal fees which you might not be able to check until you go through the process yourself. Checking references allows you to avoid some pitfalls when hiring an attorney. 

 

Ask the attorney to share a few references who you can contact to an idea of what to expect if you hire the attorney. Ideally, you want the references to be someone who had a similar case, but that is not necessary. 

 

If you are concerned that the attorney would only provide you with references that they know are positive, you can check references through other sources. For example, there are several reliable websites that have online reviews for attorneys. You also contact the state bar association and check with your friends, family, and coworkers if they have any references for their attorney. Some legal directors may also include client ratings and testimonials. 

Legal Fees 

Once you have decided to hire an attorney, you need to get complete clarification on their legal fee structure. Some attorneys work on a contingency fee basis where you only pay if you get a favorable outcome from the case, while others charge their fees regardless of the outcome. Having a clear and transparent discussion about the fee structure can help you avoid misunderstandings that can be frustrating to handle at a later stage.
