Understanding the Impact of DUI Convictions

Data from the Virginia Department of Transportation shows that more than 14,000 DUI cases were reported in 2022. While you may think that only alcoholics and irresponsible individuals are convicted of DUIs, this is not always the case. Even responsible individuals can make a mistake that escalates and affects their reputation and careers, as was the case with Williamsburg attorney James H. Wren II, 68, who was convicted of reckless driving and operating a motor vehicle under the influence by a jury on February 16, 2024.

The Case 

Wren was pulled over by the cops in May 2023 while driving to represent a client in Whitley County Circuit Court. The client in question, Carlos Amos Moses Jr., was on trial for numerous charges, including attempted murder. The arresting officers responded to a 911 call stating that a car was being driven erratically, endangering the lives of other motorists. 

Wren was arrested on suspicion of drunk driving at approximately 8:40 a.m. on May 24, 2023, and taken to Baptist Health Corbin for blood testing. The sobriety tests revealed that his BAC level was 0.175, twice the legal limit in the state of Virginia. 

In his defense, Wren stated that his BAC was so high because he overused testosterone gel, which contains ethanol. He also added that his overuse of the gel, coupled with other medications, is what led to his impaired-like state. However, he did admit to not sleeping the previous night and consuming a glass of wine at approximately 4:30 am. 

The attorney also pleaded for the court to convict him of reckless driving, which does not carry a jail sentence because he had many clients to represent. However, special prosecutor Teran Helm argued that the wording of DUI laws in Virginia does not allow unintentional impairment to be grounds for leniency. 

The trial lasted for two days, and the jury deliberated for 45 minutes before finding Wren guilty of reckless driving and operating a motor vehicle under the influence. He was sentenced to pay the statutory maximum fine of $100 for reckless driving and the statutory maximum fine of $500 for the DUI conviction. He was also sentenced to serve ten days in the Whitley County Detention Center.

Wren’s case is not an isolated one. With so many DUI cases reported in Virginia every year, it’s important to be aware of the ramifications of getting convicted for a DUI offense, which can range from jail time, fines, license suspension, mandatory alcohol education programs, and more.
