Balvant Parekh Centre for General Semantics and Other Human Sciences in collaboration with the English and Foreign Languages University, Hyderabad is going to organize the Seventh National Seminar on “The Enigma of Law”

Date: 2nd – 4th November, 2015
Venue: The English and Foreign Languages University, Hyderabad

Concept Note:
The question of the law is a continuous concern in Derrida’s writings, especially in his later work. Even though “Force of Law” approaches the question of the law primarily in its distinction from the legal concept of right and within the horizon of the problematic of justice, this 1989 text refines numerous, earlier reflections on the law and anticipates others that will be developed in greater detail in later works. I mention only the distinction of the Greek notion of nomos and Mosaic Law, the difference between the laws and the Law, the enigma of the injunctive and binding character of all laws, along with the hyperbolic, but also aporetic, nature of these injunctions, the violence involved in making the law, its subsequent power or force, and so forth.

On a broader level, “Force of Law” intersects with Derrida’s elaborations elsewhere on the relation of the law to nationalism and community formation, its connection with particular idioms and language in general, the commerce between the theological and the political, that is, also the question of secularization, the whole Schmittean problematic of the state of exception, and the foundation of authority. As its very title suggests, however, “Force of Law” is also a meditation on the metaphysical concept of force, on the difference of force from violence, and, more generally, on what to understand by ‘deconstruction,’ how the latter is linked to the question of the law and under what conditions something like a deconstruction becomes possible and necessary.

Registration Fee:
Each participant is required to pay a registration fee of Rs.1500/- through a bank draft payable to “Balvant Parekh Centre for General Semantics and Other Human Sciences” on any bank in Baroda. The fee will take care of lunch and tea during the seminar. The fee does not include the cost of accommodation, and is non-refundable.

Those who need accommodation at Hyderabad should get in touch with the local convener. Participants have to make their own travel arrangements.

Deadline for Application:
The last date for receiving the proposal for participation and 300-word abstract is 31st August, 2015.

The abstract may be sent as an email attachment to Prafulla Kar (prafullakar@gmail.com), with a copy to D. Venkat Rao, the Local Convener of the Seminar. Selection for participation will be made by 15th September, 2015. The last date for registration by sending the required fee is 30th September, 2015. PG College of Law, Osmania University and ICSI are jointly organizing the two day National Research Seminar on “Corporate Laws & Challenges to the New Governments”.

Date: 25th – 26th July, 2015
Venue: Seminar Hall, Prof. G. Ram Reddy Centre for Distance Education, Osmania University, Hyderabad

The 21st Century throws great challenges to the Indian economy. The status of India as No.1 in the global economy depends upon the legislative support in the form of corporate legislations apart from other factors. The present Central government has announced various programmes like “Make in India” and other programmes. In line with the central government, various state governments are also announcing programmes to achieve a rapid economic development and growth. In this connection the small and medium industries need high encouragement and protection from the onslaught of the giant business houses for which the Competition Act, 2002 plays a very pivotal role.

The corporate legislations like the Companies Act, 2013, The Securities Exchange Board of India Act, 1992, The Securities Contracts (Regulations) Act, 1956, Depositories Act, 1996, The Foreign Exchange Management Act, 1999, The Foreign Contribution (Regulation) Act, 2010 and other allied legislations play a very centrifugal role. These legislations are essential for the corporate governance and have high relevance in the light of the proposed government policy of enhancing the FDI ratio.

So it is essential now to study whether these existing corporate laws are enough and sufficient to channelize the flow of foreign investment into India and further controlling the share market, unhealthy takeover bids, facilitating healthy growth of medium and small scale industries and the growth and development of giant Institutions. Further, when the foreign investment is encouraged very much in the present scenario, a pertinent question is that whether this foreign contribution will help the massive and fast growing number of younger generation to get suitable employment based on their eligibility, qualifications and training.

Absorption of this massive younger generation through proper employment is a great challenge to the government. The finality is that India belongs to this younger generation, which will ultimately mould India’s future status in the world economy in the ensuing years. Thus this seminar is aimed at analysing the efficacy and relevance of the present corporate legislations to make India a great giant in the economic front as the industry, trade and commerce ultimately form the backbone for the nation’s economy. A deep rooted study is invited to analyse the above issues and find out the efficacy of these corporate laws and suggestions for improvement.

Sub-Themes:

  • Companies Act, 2013 and allied laws, their relevance and contribution to meet the challenges in the 21st Century
  • Laws relating to foreign investment in India and the issues thereon
  • Competition law in India, its role in promoting competition in markets in India
  • Social Security and human rights concept in corporate sector

Call for Papers:
Papers are invited from the field of Law, Management, Finance, Engineering or any other discipline and they are requested to contribute their original and unpublished articles relate to the Seminar Themes and any other issues relevant to the subject. CS members and other professionals may contribute the papers, though they are not pursuing Ph.D.

Participants are requested to send their abstracts / full length research papers on:

  • A4 size paper using 12 font size on Times New Roman with single space
  • Abstract should include a concise title, name of the author(s) and address
  • Name of the presenting author should be underlined

Amity Law School, Delhi is going to organize a National Symposium on ‘Competition Law in India”

Date: 21st August, 2015
Venue: Amity Law School, Delhi

Since its independence, India adopted a socialist pattern based on the Directive Principles of State Policy to prevent concentration of wealth and to maximize the maximum good of maximum number of people. Licensing policy led to the growth of Monopolistic industries resulting into Monopolistic, Restrictive and Unfair Trade Practices leading to the enactment of Monopolies and Restrictive Trade Practices Act. With the development of liberalization, privatization and globalization, MRTP Act was deficient to cope up with the economic reforms and led to the repeal of the same and the enactment of the Competition Act, 2002.

The Symposium aims to stress on the objective of Competition Law that is to maximise the consumer welfare by promoting competition by offering better quality products at lower prices. Competition is indisputably advantageous to all the market participants whether it is consumer or business, thereby accelerating the growth of the economy. Competitive Industry offers its consumers wider options to choose the product and that too at lower price. It also motivates producers to do maximum utilization of available resources and also to invent new technologies, thereby, to reduce cost of production and to enhance quality.

The subject-matter of competition law and its various arenas is a priority area for the Government, the Competition Commission of India and the larger global community. National Law University Odisha, Cuttack is pleased to announce the Call for Papers for the Colloquium Opus Law Journal (Vol. 2, Issue 2) on “Concept of State in Changing Constitutional Frame”.

Concept Note:
The shadow of the state nowadays, falls upon every sphere of human activity. The state shapes and controls, or regulates, authorizes, supervises or proscribes, myriad activities, from education, to sanitation, to social welfare, to domestic order and external defence, economic management, etc. Certain aspects of life, which otherwise are considered to be private or personal, via, marriage, abortion, divorce, etc., are also subject to the authority of the state. It is no surprise therefore, that the central question has been, defining the nature or character of the state. The necessity to explain the nature of state stems from the fact that the term “State” is the central concept in constitutional law.

The acts attributed to “the State” are acts which result in legal consequences in accordance with their contents. Every such act is performed, in exercise of power granted to the actor through a rule of competence. This power is the capacity to create rules that bind others. This difference in legal position between individuals as holders of private autonomy and certain qualified persons, possessing power, in furtherance of a rule of competence, has given rise to the idea that the power which has the character of public authority and the acts in which it finds expression, cannot “properly” be ascribed to the acting individual. The acting individual is considered to have acted “on behalf of the State”, or as an “organ of the state”.

When these “organs of the State” act without having the capacity, or do so, in a manner, at variance with, or contrary to, the manner prescribed, the validity of their action comes under question. The governing power wherever located must be subject to the fundamental constitutional limitations, for the Constitution was framed on the theory that limitation should exist on the exercise of power by the State.

The character of the State has undergone drastic changes in recent years, the problem that continues is that, in what circumstances an act of an individual or a group is to be considered to be an action of the state, and that particular individual or group is to be considered as an “organ of the State”. With this background the Colloquium Opus Law Journal invites papers on the changing dimensions of role of State under or connected with any of the following subthemes:

    • Evolution, Development and philosophical foundations of the State in various legal systems viz. England, United States of America and India;
    • The concept of “State”, under the Constitution of India, with reference to:
      • Fundamental Rights,
      • Directive Principles of State Policy, and
      • Tortious and contractual liability of the State

  • Judiciary within the ambit of the expression State
  • Interpretation of “Other Authorities” in the light of changing role of State.
