The Honorable Supreme Court, on Friday, agrees to hear the petition seeking a probe into the corruption case involving judges.
The petition, filed by Ms. Kamini Jaiswal, sought to address the controversy involving a diary, allegedly left behind by former Arunachal Pradesh Chief Minister Kalikho Pul before his suicide, which names some apex court judges in connection with monetary demands.
The alleged diary also involves the name of a High Court Judge, who allegedly conspired with a “hawala dealer” to influence the outcome of a case pending in the Supreme Court in favour of a debarred private medical college.
The Honorable Court, while fixing 13th November, as the date of the hearing, stated that “This matter is very important for this institution and also for the whole nation…let it be placed before a Constitution Bench to be heard on a priority basis.”
The development assumes immense significance since the top court has, perhaps for the first time, agreed to hear a petition, which demands an independent probe that might lead to investigation of judges at the highest level.
The petitioner has also requested the Bench, to shift the case from the Central Bureau of Investigation, to a Special Investigation Team led by a retired Chief Justice of India, in order to ensure a fair investigation. the reasons for the same were stated to be the fact that the case involves “corruption in the very highest echelons of power, including the justice delivery system.”
Besides, in an interim order, Hon’ble Justice Chelameswar had directed that the case diary, materials and evidence collected so far by the CBI in the corruption case, be sealed and produced before the Constitution Bench on November 13. He recorded that these precautionary measures to keep the evidence safe was necessary “having regard to the nature of the case”.
