SC: Affirmation of order is not possible in the event of absence of the findings and discussions upon the issues pertaining to the cases

The Apex Court on 16.11.2018, in Sumer Singh Jat & Ors. Etc.Etc. v State of Rajasthan & Ors. Etc.Etc[1] allowed the  appeals  were made  against  the High Court of Judicature  for Rajasthan  Bench at  Jaipur‘s  and Jodhpur’s  judgments and orders wherein  the  appeals  made  by the appellants were dismissed.

FACTS:

 The Appellant No. 1 along with others had  made intra court appeals in  the High Court for Rajasthan, in the benches of   Jaipur  and Jodhpur  respectively  the Single Judge’s made in the  petitions, which was then affirmed by the the Division Bench while   dismissing  appellants appeals  which eventually gave rise to the  filing of  present appeals before the Apex Court.

ISSUE: Whether the orders of the Court are  sustainable in law?

HELD:

The Apex Court while setting aside the judgments and orders, permitted the appeal and remanded the case to the Division Bench of the High Court for considering the appeals based upon  merits.
