Amit Shah’s son Jay Shah was successful in restoring the gag order on The Wire on 20th February, 2018 as the Gujarat High Court restored the gag order on The Wire by reversing the decision given by the Ahmedabad district court in the month of December, 2017 where they had lifted the ex-parte injunction granted to Jay Shah over The Wire.
The district court had allowed the web portal to write about Jay’s business, but there had to be no contention about Hon’ble Prime Minister Narendra Modi.
Earlier The Wire had accused Jay Shah son of the current BJP president of corruption by saying that Jay’s firms turnover had increased 16000 times after Narendra Modi was elected as the Prime Minister. In response to the allegation Jay had filed a civil suit against The Wire and claimed damages of 100 crore for causing injury to his reputation.
The Ahmedabad district court granted an interim injunction to Jay Shah thus restraining the portal from writing anything over the matter. But in a dramatic turnover of events the same court had lifted the injunction and the same was challenged by Jay Shah in Gujarat High Court.
Listening to the appeal the Gujarat High Court had reserved its decision on 20th January, 2018. This case was dealt by Hon’ble Justice Paresh Upadhyay.
The lawyers representing The Wire had earlier said before the court that there can be injunction granted over them as it prevented public disclosure of super profits earned by Jay’s firm thereby getting more and more people to talk about the same. The web portal nowhere wanted to create any situation of chaos.
On the other hand senior counsel Nirupam Nanavati appearing on behalf of Jay Shah that the web portal without any sufficient evidence regarding the matter had accused Jay Shah of misusing his dad’s position and alleged him of wrongly using their closeness with the Prime Minister. He accused the web portal of innuendo in their language and were using the term public interest just to save themselves.
The Gujarat High Court restored the gag order over The Wire. Gag order in legal meaning refers to an order which prohibits any publisher from public disclosure of any particular information. The Wire said that they will challenge the order of Gujarat High Court before the Supreme Court.
