The Delhi High Court on 19.12.2018, in PQR v STATE & ORS. , allowed the petition pertaining to defamation. The petitioner as well as the respondent had got engaged into a serious verbal duel during a debate telecasted live on TV, while both had instituted cases of criminal complaint against each other where each had been alleged to have committed defamation wherein the Metropolitan Magistrate, detected grounds for proceedings against both the petitioner and respondent in the criminal complaint cases respectively , summoning them to appear which was eventually challenged through the present petition.
When the portions of the debate, bearing relevancy were shown to the Metropolitan Magistrate, an observation was made that the words uttered by the petitioner resulted into defamation .
DECISION HELD BY THE DELHI HIGH COURT:
The Delhi High Court while allowing the petition , quashed the order of the Metropolitan Magistrate while upholding that the criminal complaint that had led to the summoning order made against the petitioner was in consequence to the counter-blast of the complaint which was made by the former.
